The term “lobbying” evokes negative associations in the public sphere, with phenomena such as intrigue, blackmail, vested interests and “under the table” transactions inevitably associated with the term. For starters, this is a myopic view, which has been partly shaped by entertaining political thrillers and the mass media. On the contrary, it is a complex political phenomenon, namely the organized and institutionally guaranteed expression of interests within a political system, which is found in liberal democracies. The aim of this paper is to approach the phenomenon of lobbying through the prism of political science, presenting both its institutional dimension and the possible side effects resulting from the absence of an adequate regulatory framework. Through historical data, institutional comparisons and specific examples, a critical analysis of the function of lobbying at the national and supranational levels will be attempted.
The term lobbying first appeared in the American press in the early 19th century, specifically in 1830, originating from the lobby of the Willard Hotel in Washington. This term is used to describe individuals who flanked members of the American Congress in order to influence certain decisions regarding various legislative resolutions. Thomas R. Dye defines politics as “a dispute over scarce government resources, who receives them, where, when, why and how” (Hrebenar et al., 2009). This definition is useful for understanding the centrifugal and multifaceted tendencies within a political system and will be based specifically on the American case. This choice is justified by the fact that this particular political system consists of a complex system of balancing interests, where a number of politicians came from the private sector and not from the federal government. The representation of these interests will play a decisive role in its formation. It is also striking that it took decades, and more specifically from the mid-19th century to 1913, to create the Department of Labor, which is an influential organization that wishes to influence decisions from business interests to the teachers' union (Lavdas, 2004).
Institutional recognition was achieved in 1946 when the legislation on Lobbying was codified with the Federal Regulation of Lobbying Act, which set out the procedures for the operation of lobbying and specifically in section 307 the definition of what a lobbyist is, is given (United States General Accounting Office, 1946). Specifically, it concerns any person who, either himself or through another actor indirectly or directly, receives remuneration or other items of value with the aim of achieving the acceptance or rejection of legislation in the US Congress and secondly the direct or indirect influence of the incorporation or rejection of legislation (Wright et al., 2002). Also, the same paragraph describes in detail the obligations regarding the registration of these individuals in the corresponding register, as well as the obligation to declare their personal information and that of their employer, the duration of their work and the remuneration they will receive. In the process, and in 1995, the legislation evolved with the Lobbying Disclosure Act, a legislative act which was a “catalyst” regarding the accountability of lobbies and covered several gaps in the previous legislation as it strengthened accountability and transparency and contributed to the stricter regulation of lobbying practices (Lavdas 2004).
In essence, lobbying firms are legal entities that offer their services to organized interests that wish to communicate with a state actor with two goals: on the one hand, to present their positions and, on the other hand, to influence public policy (Lavdas, 2004). In addition, this phenomenon is not only found at the federal level but at all levels of government such as states, regions or municipalities. Specifically, it is estimated that in the United States in 2023 more than four billion dollars was spent on lobbying activities (Massoglia et al., 2024). At this point, the institution of Political Action Committees (PAC) should also be mentioned, which is of particular importance in the United States. This is because PACs are entities that collect contributions from their members and then channel these resources for or against candidates, election campaigns and legislation as the costs of conducting a campaign range at astronomical levels (Lavdas 2004, p. 231).
On the other side of the Atlantic, the European Union attaches particular importance to the operation of lobbying firms and constantly emphasizes the need for transparency and accountability as well as dialogue with representative organizations and civil society as stated in Article 11 of the Treaty on European Union (Transparency International, 2024). Furthermore, the European Parliament, the European Commission and the Council of the European Union have a Transparency Register which is accessible to all and unlike the USA, the institution of PACs is absent and instead significant emphasis is placed on transparency and accountability as well as access by citizens to this data. Registration in the Transparency Register is essential for those who intend to influence the creation and implementation of public policy in the institutions of the European Union.
Despite the positive elements it can offer, the practice of lobbying involves significant risks, especially when it operates in conditions of institutional ambiguity or inadequate regulation. In cases where there is no clear legal and institutional framework, it is difficult to distinguish whether actions such as the provision of gifts, meals or travel constitute forms of legitimate influence or covert bribery which operate within a legally unclear framework. A significant role in the loss of trust by civil society in the political system in the US has arisen due to the revolving door phenomenon. Specifically, the mobility of government officials in high positions in the private sector as lobbyists and vice versa, i.e. from corporate executives to government positions, blurs the boundaries between the private and public sectors and this role switching creates a network of mutual dependencies, thus intensifying citizens' concerns. (Drutman, 2015). In addition, the previous service of these individuals in public administration results in them having a potential influence on decision-making processes due to their networking in high-ranking circles (Vidal J. et al. 2012).
Subsequently, lobbying has the potential to offer valuable knowledge at the government level, as lobbying firms are mainly staffed by technocrats, lawyers and economists. Nevertheless, lobbying can have a positive effect if it is carried out in conditions of transparency and accountability, especially when civil society organizations or vulnerable groups are represented, and can lead to reforms that benefit society as a whole. For example, in the United States, the organization Mothers Against Drunk Driving (MADD) contributed significantly to raising the legal drinking age to 21 years (Yu et al, 2018). Similarly, the action of the Greek lobby in the United States has contributed to maintaining strategic relations between the United States and Greece, regularly highlighting issues of national interest.
In no case is this multifaceted phenomenon a panacea and for this reason a state must ensure increased accountability that will limit corruption and gain the trust of civil society. Many times decisions that are the result of lobbying, such as, for example, laws on abortion or regarding the use and possession of specific types of firearms, have led to polarization and intense debate in the public sphere. From the above, it follows that in any case lobbying is an opportunity to promote essential issues at the highest levels of government, but the absence of regulatory content will cause entanglement phenomena that will in turn alienate civil society and cause or intensify the already existing distrust towards the political system and institutions.

Στο άκουσμα του όρου «lobbying», προκαλούνται αρνητικοί συνειρμοί στη δημόσια σφαίρα με φαινόμενα όπως δολοπλοκίες, εκβιασμοί, ύπουλα συμφέροντα και συναλλαγές “κάτω από το τραπέζι” να συνδέονται αναπόφευκτα με το συγκεκριμένο όρο. Αρχικά, αυτή αποτελεί μία μυωπική αντίληψη, η οποία έχει εν μέρει διαμορφωθεί από ψυχαγωγικά πολιτικά θρίλερ και μέσα μαζικής ενημέρωσης. Αντιθέτως, πρόκειται για ένα σύνθετο πολιτικό φαινόμενο, δηλαδή την οργανωμένη και θεσμικά κατοχυρωμένη έκφραση συμφερόντων εντός ενός πολιτικού συστήματος, το οποίο απαντάται στις φιλελεύθερες δημοκρατίες. Στόχος του παρόντος κειμένου είναι να προσεγγίσει το φαινόμενο του lobbying μέσα από το πρίσμα της πολιτικής επιστήμης, παρουσιάζοντας τόσο τη θεσμική του διάσταση όσο και τις πιθανές παρενέργειες που προκύπτουν από την απουσία επαρκούς ρυθμιστικού πλαισίου. Μέσα από ιστορικά στοιχεία, θεσμικές συγκρίσεις και συγκεκριμένα παραδείγματα, θα επιχειρηθεί μια κριτική ανάλυση της λειτουργίας του lobbying στο εθνικό και υπερεθνικό επίπεδο.
Ο όρος lobbying εμφανίζεται αρχικά στον αμερικανικό τύπο στις αρχές του 19ου αιώνα και συγκεκριμένα το 1830, προερχόμενος από το lobby του ξενοδοχείου Willard στην Ουάσινγκτον. Ο όρος αυτός χρησιμοποιείται για τη περιγραφή ατόμων, τα οποία πλαισίωναν μέλη του Αμερικανικού Κογκρέσου με σκοπό να επηρεάσουν ορισμένες αποφάσεις αναφορικά με διάφορα ψηφίσματα νομοσχεδίων. Ο Thomas R. Dye προσδιορίζει την πολιτική ως “διαμάχη για ελάχιστους κυβερνητικούς πόρους, ποιος τους λαμβάνει, που, πότε, γιατί και με ποιόν τρόπο” (Hrebenar et al., 2009). Αυτός ο ορισμός είναι χρήσιμος για να γίνουν κατανοητές οι φυγόκεντρες και πολυσχιδείς τάσεις εντός ενός πολιτικού συστήματος και συγκεκριμένα θα δοθεί βάση στην αμερικανική περίπτωση. Η επιλογή αυτή αιτιολογείται από το γεγονός πως το συγκεκριμένο πολιτικό σύστημα αποτελείται από ένα πολύπλοκο σύστημα εξισορρόπησης συμφερόντων, όπου αριθμός πολιτικών προήλθαν από τον ιδιωτικό τομέα και όχι από την ομοσπονδιακή κυβέρνηση. Η εκπροσώπηση των συμφερόντων αυτών θα διαδραματίσει καθοριστικό ρόλο στην διαμόρφωση του. Επίσης, προξενεί εντύπωση το γεγονός ότι χρειάστηκε να περάσουν δεκαετίες και πιο συγκεκριμένα από τα μέσα του 19ου μέχρι το 1913 ώστε να δημιουργηθεί το Υπουργείο Εργασίας-Department of Labour, το οποίο αποτελεί μία οργάνωση με επιρροή και επιθυμεί να επηρεάσει τις αποφάσεις από επιχειρηματικά συμφέροντα μέχρι την ένωση εκπαιδευτικών (Λάβδας, 2004).
Η θεσμική αναγνώριση πραγματοποιείται το 1946 όταν κωδικοποιείται η νομοθεσία για το Lobbying με τον Ομοσπονδιακό Νόμο Ρύθμισης και Άσκησης Παρασκηνιακής Πίεσης, στον οποίο καθορίζονται οι διαδικασίες για την λειτουργία του lobbying και συγκεκριμένα στο εδάφιο 307 δίνεται και ο ορισμός του τι είναι λομπίστας (United States General Accounting Office, 1946). Συγκεκριμένα, αφορά οποιοδήποτε άτομο το οποίο είτε το ίδιο είτε μέσω ενός άλλου δρώντα έμμεσα ή άμεσα, λαμβάνει αμοιβή ή άλλα αντικείμενα αξίας με σκοπό να επιτελέσει την αποδοχή ή απόρριψη νομοθεσίας στο Κογκρέσο των ΗΠΑ και δεύτερον την επιρροή άμεσα ή έμμεσα ενσωμάτωσης ή απόρριψης νομοθεσίας (Wright et al., 2002). Επίσης, στο ίδιο εδάφιο περιγράφονται με λεπτομερή τρόπο οι υποχρεώσεις αναφορικά με την εγγραφή των ατόμων αυτών στο αντίστοιχο μητρώο, καθώς και την υποχρέωση να δηλώσουν τα προσωπικά τους στοιχεία αλλά και του εργοδότη τους, την διάρκεια της εργασίας τους και την αμοιβή την οποία θα λαμβάνουν. Στην πορεία και δη το 1995, η νομοθεσία εξελίχθηκε με το Lobbying Disclosure Act, νομοθετική πράξη η οποία αποτέλεσε «καταλύτη» αναφορικά με την λογοδοσία των lobbies και κάλυψε αρκετά κενά από την προηγούμενη νομοθεσία καθώς, ενισχύεται η λογοδοσία και η διαφάνεια και συνέβαλε στην πιο αυστηρή ρύθμιση της πρακτικής του lobbying (Λάβδας, 2004).
Επί της ουσίας, οι εταιρείες lobbying αποτελούν νομικά πρόσωπα τα οποία προσφέρουν τις υπηρεσίες τους σε οργανωμένα συμφέροντα τα οποία επιθυμούν να έρθουν σε επικοινωνία με κάποιο κρατικό παράγοντα με δύο στόχους, αφενός να παρουσιάσουν τις θέσεις τους και αφετέρου να επηρεάσουν την δημόσια πολιτική (Λάβδας, 2004). Επιπροσθέτως, αυτό το φαινόμενο δεν συναντάται μόνο στο ομοσπονδιακό επίπεδο αλλά σε όλα τα επίπεδα διακυβέρνησης όπως τις πολιτείες, τις περιφέρειες ή τους δήμους. Συγκεκριμένα, υπολογίζεται ότι στις Ηνωμένες Πολιτείες το 2023 δαπανήθηκαν περισσότερα από τέσσερα δισεκατομμύρια δολάρια σε δραστηριότητες άσκησης επιρροής (Massoglia et al., 2024). Στο σημείο αυτό, πρέπει να αναφερθεί και ο θεσμός των Political Action Committees ( PAC ) ο οποίος στις Ηνωμένες Πολιτείες έχει ιδιαίτερη σημασία. Αυτό επειδή, τα PAC αποτελούν οντότητες οι οποίες αντλούν συνεισφορές από τα μέλη τους και ύστερα διοχετεύουν αυτούς τους πόρους υπέρ ή κατά υποψήφιων, προεκλογικών εκστρατειών και νομοθεσίας καθώς τα έξοδα διεξαγωγής μιας εκστρατείας κυμαίνονται σε αστρονομικά επίπεδα (Λάβδας 2004, σελ. 231).
Στην άλλη μεριά του ατλαντικού, η Ευρωπαϊκή Ένωση αποδίδει ιδιαίτερη σημασία στην λειτουργία των εταιρειών lobbying και τονίζει συνεχώς την ανάγκη για διαφάνεια και λογοδοσία καθώς και διάλογο με αντιπροσωπευτικές οργανώσεις και την κοινωνία των πολιτών όπως αναφέρεται στο άρθρο 11 της Συνθήκης Ευρωπαϊκής Ένωσης (Transparency International, 2024). Επιπλέον, το Ευρωπαϊκό Κοινοβούλιο, η Ευρωπαϊκή Επιτροπή και το Συμβούλιο της Ευρωπαϊκής Ένωσης διαθέτουν Μητρώο Διαφάνειας το οποίο είναι προσβάσιμο σε όλους και σε αντίθεση με τις ΗΠΑ απουσιάζει ο θεσμός των PAC και δίνεται σημαντική έμφαση στη διαφάνεια και τη λογοδοσία καθώς και την πρόσβαση από τους πολίτες σε αυτά τα δεδομένα. Η εγγραφή στο Μητρώο Διαφάνειας είναι απαραίτητη για όσους σκοπεύουν να επηρεάσουν την δημιουργία και εφαρμογή της δημόσιας πολιτικής στους θεσμούς της Ευρωπαϊκής Ένωσης.
Παρά τα θετικά στοιχεία που μπορεί να προσφέρει, η πρακτική του lobbying ενέχει σημαντικούς κινδύνους και ιδιαίτερα όταν λειτουργεί σε συνθήκες θεσμικής ασάφειας ή ανεπαρκούς ρύθμισης. Σε περιπτώσεις στις οποίες δεν υπάρχει σαφές νομικό και θεσμικό πλαίσιο, είναι δύσκολο να διακρίνει κανείς αν ενέργειες όπως η παροχή δώρων, γευμάτων ή ταξιδιών αποτελούν μορφές νόμιμης επιρροής ή συγκαλυμμένης δωροδοκία και κινούνται εντός ενός νομικά ασαφούς πλαισίου. Σημαντικό ρόλο στην απώλεια εμπιστοσύνης από την κοινωνία των πολιτών προς το πολιτικό σύστημα στις ΗΠΑ έχει προκύψει εξαιτίας του φαινομένου της περιστρεφόμενης πόρτας (revolving door). Συγκεκριμένα, η κινητικότητα κυβερνητικών αξιωματούχων σε υψηλές θέσεις στον ιδιωτικό τομέα ως λομπίστες αλλά και το αντίστροφο ,δηλαδή από στελέχη εταιριών σε κυβερνητικές θέσεις, καθιστά δυσδιάκριτα το όρια μεταξύ ιδιωτικού και δημόσιου τομέα και αυτή η εναλλαγή ρόλων δημιουργεί ένα δίκτυο αμοιβαίων εξαρτήσεων εντείνοντας με αυτό τον τρόπο την ανησυχία των πολιτών. (Drutman, 2015). Επιπροσθέτως, η πρότερη υπηρεσία αυτών των ατόμων στην δημόσια διοίκηση έχει ως αποτέλεσμα να έχουν δυνάλογη επιρροή στις διαδικασίες λήψης αποφάσεων εξαιτίας της δικτύωσης τους σε υψηλά ιστάμενους κύκλους (Vidal J. et al. 2012) .
Στη συνέχεια, το lobbying έχει την δυνατότητα να προσφέρει πολύτιμες γνώσεις σε κυβερνητικό επίπεδο, καθώς οι εταιρείες lobbying στελεχώνονται κυρίως από τεχνοκράτες, δικηγόρους και οικονομολόγους. Παρά ταύτα, το lobbying μπορεί να λειτουργήσει θετικά εφόσον ασκείται σε συνθήκες διαφάνειας και λογοδοσίας, ιδιαίτερα όταν εκπροσωπούνται οργανώσεις της κοινωνίας των πολιτών ή ευάλωτες ομάδες, μπορεί να οδηγήσει σε μεταρρυθμίσεις οι οποίες ωφελούν το κοινωνικό σύνολο. Ενδεικτικά, στις Ηνωμένες Πολιτείες, η οργάνωση Mothers Against Drunk Driving (MADD) συνέβαλε καθοριστικά στην αύξηση του νόμιμου ορίου ηλικίας για την κατανάλωση αλκοόλ στα 21 έτη (Yu et al, 2018). Αντίστοιχα, η δράση του ελληνικού lobby στις ΗΠΑ έχει συνεισφέρει στη διατήρηση των στρατηγικών σχέσεων μεταξύ Ηνωμένων Πολιτειών και Ελλάδας, θέτοντας τακτικά στο επίκεντρο θέματα εθνικού ενδιαφέροντος.
Σε καμία περίπτωση, αυτό το πολυσχιδές φαινόμενο δεν αποτελεί πανάκεια και για αυτό τον λόγο μία πολιτεία οφείλει να φροντίσει για αυξημένη λογοδοσία η οποία θα περιορίσει την διαφθορά και θα αποκτήσει την εμπιστοσύνη της κοινωνίας των πολιτών. Πολλές φορές αποφάσεις που είναι αποτελέσματα lobbying όπως, για παράδειγμα οι νόμοι σχετικά με τις αμβλώσεις ή αναφορικά με την χρήση και κατοχή συγκεκριμένων ειδών πυροβόλων τυφεκίων έχουν οδηγήσει σε πόλωση και έντονη συζήτηση στη δημόσια σφαίρα. Από τα παραπάνω, προκύπτει ότι σε κάθε περίπτωση το lobbying αποτελεί μία ευκαιρία για προώθηση ουσιαστικών ζητημάτων στα υψηλότερα κυβερνητικά επίπεδα, όμως η απουσία ρυθμιστικού περιεχομένου θα προκαλέσει φαινόμενα διαπλοκής τα οποία με τη σειρά τους θα θέσουν σε αποξένωση την κοινωνία των πολιτών και θα προκαλέσουν ή θα εντείνουν την ήδη υπάρχουσα δυσπιστία απέναντι στο πολιτικό σύστημα και τους θεσμούς.

Also, the same paragraph describes in detail the obligations regarding the registration of these individuals in the corresponding register, as well as the obligation to declare their personal information and that of their employer, the duration of their work and the remuneration they will receive. In the process, and in 1995, the legislation evolved with the Lobbying Disclosure Act, a legislative act which was a “catalyst” regarding the accountability of lobbies and covered several gaps in the previous legislation as it strengthened accountability and transparency and contributed to the stricter regulation of lobbying practices (Lavdas 2004).
In essence, lobbying firms are legal entities that offer their services to organized interests that wish to communicate with a state actor with two goals: on the one hand, to present their positions and, on the other hand, to influence public policy (Lavdas, 2004). In addition, this phenomenon is not only found at the federal level but at all levels of government such as states, regions or municipalities. Specifically, it is estimated that in the United States in 2023 more than four billion dollars was spent on lobbying activities (Massoglia et al., 2024). At this point, the institution of Political Action Committees (PAC) should also be mentioned, which is of particular importance in the United States. This is because PACs are entities that collect contributions from their members and then channel these resources for or against candidates, election campaigns and legislation as the costs of conducting a campaign range at astronomical levels (Lavdas 2004, p. 231).
On the other side of the Atlantic, the European Union attaches particular importance to the operation of lobbying firms and constantly emphasizes the need for transparency and accountability as well as dialogue with representative organizations and civil society as stated in Article 11 of the Treaty on European Union (Transparency International, 2024). Furthermore, the European Parliament, the European Commission and the Council of the European Union have a Transparency Register which is accessible to all and unlike the USA, the institution of PACs is absent and instead significant emphasis is placed on transparency and accountability as well as access by citizens to this data. Registration in the Transparency Register is essential for those who intend to influence the creation and implementation of public policy in the institutions of the European Union.
Despite the positive elements it can offer, the practice of lobbying involves significant risks, especially when it operates in conditions of institutional ambiguity or inadequate regulation. In cases where there is no clear legal and institutional framework, it is difficult to distinguish whether actions such as the provision of gifts, meals or travel constitute forms of legitimate influence or covert bribery which operate within a legally unclear framework. A significant role in the loss of trust by civil society in the political system in the US has arisen due to the revolving door phenomenon. Specifically, the mobility of government officials in high positions in the private sector as lobbyists and vice versa, i.e. from corporate executives to government positions, blurs the boundaries between the private and public sectors and this role switching creates a network of mutual dependencies, thus intensifying citizens' concerns. (Drutman, 2015). In addition, the previous service of these individuals in public administration results in them having a potential influence on decision-making processes due to their networking in high-ranking circles (Vidal J. et al. 2012).
Subsequently, lobbying has the potential to offer valuable knowledge at the government level, as lobbying firms are mainly staffed by technocrats, lawyers and economists. Nevertheless, lobbying can have a positive effect if it is carried out in conditions of transparency and accountability, especially when civil society organizations or vulnerable groups are represented, and can lead to reforms that benefit society as a whole. For example, in the United States, the organization Mothers Against Drunk Driving (MADD) contributed significantly to raising the legal drinking age to 21 years (Yu et al, 2018). Similarly, the action of the Greek lobby in the United States has contributed to maintaining strategic relations between the United States and Greece, regularly highlighting issues of national interest.
In no case is this multifaceted phenomenon a panacea and for this reason a state must ensure increased accountability that will limit corruption and gain the trust of civil society. Many times decisions that are the result of lobbying, such as, for example, laws on abortion or regarding the use and possession of specific types of firearms, have led to polarization and intense debate in the public sphere. From the above, it follows that in any case lobbying is an opportunity to promote essential issues at the highest levels of government, but the absence of regulatory content will cause entanglement phenomena that will in turn alienate civil society and cause or intensify the already existing distrust towards the political system and institutions.

Lobbying: Μια Σύνθετη Πολιτική Διεργασία και οι Επιπτώσεις της

Στο άκουσμα του όρου «lobbying», προκαλούνται αρνητικοί συνειρμοί στη δημόσια σφαίρα με φαινόμενα όπως δολοπλοκίες, εκβιασμοί, ύπουλα συμφέροντα και συναλλαγές “κάτω από το τραπέζι” να συνδέονται αναπόφευκτα με το συγκεκριμένο όρο. Αρχικά, αυτή αποτελεί μία μυωπική αντίληψη, η οποία έχει εν μέρει διαμορφωθεί από ψυχαγωγικά πολιτικά θρίλερ και μέσα μαζικής ενημέρωσης. Αντιθέτως, πρόκειται για ένα σύνθετο πολιτικό φαινόμενο, δηλαδή την οργανωμένη και θεσμικά κατοχυρωμένη έκφραση συμφερόντων εντός ενός πολιτικού συστήματος, το οποίο απαντάται στις φιλελεύθερες δημοκρατίες. Στόχος του παρόντος κειμένου είναι να προσεγγίσει το φαινόμενο του lobbying μέσα από το πρίσμα της πολιτικής επιστήμης, παρουσιάζοντας τόσο τη θεσμική του διάσταση όσο και τις πιθανές παρενέργειες που προκύπτουν από την απουσία επαρκούς ρυθμιστικού πλαισίου. Μέσα από ιστορικά στοιχεία, θεσμικές συγκρίσεις και συγκεκριμένα παραδείγματα, θα επιχειρηθεί μια κριτική ανάλυση της λειτουργίας του lobbying στο εθνικό και υπερεθνικό επίπεδο.
Ο όρος lobbying εμφανίζεται αρχικά στον αμερικανικό τύπο στις αρχές του 19ου αιώνα και συγκεκριμένα το 1830, προερχόμενος από το lobby του ξενοδοχείου Willard στην Ουάσινγκτον. Ο όρος αυτός χρησιμοποιείται για τη περιγραφή ατόμων, τα οποία πλαισίωναν μέλη του Αμερικανικού Κογκρέσου με σκοπό να επηρεάσουν ορισμένες αποφάσεις αναφορικά με διάφορα ψηφίσματα νομοσχεδίων. Ο Thomas R. Dye προσδιορίζει την πολιτική ως “διαμάχη για ελάχιστους κυβερνητικούς πόρους, ποιος τους λαμβάνει, που, πότε, γιατί και με ποιόν τρόπο” (Hrebenar et al., 2009). Αυτός ο ορισμός είναι χρήσιμος για να γίνουν κατανοητές οι φυγόκεντρες και πολυσχιδείς τάσεις εντός ενός πολιτικού συστήματος και συγκεκριμένα θα δοθεί βάση στην αμερικανική περίπτωση. Η επιλογή αυτή αιτιολογείται από το γεγονός πως το συγκεκριμένο πολιτικό σύστημα αποτελείται από ένα πολύπλοκο σύστημα εξισορρόπησης συμφερόντων, όπου αριθμός πολιτικών προήλθαν από τον ιδιωτικό τομέα και όχι από την ομοσπονδιακή κυβέρνηση. Η εκπροσώπηση των συμφερόντων αυτών θα διαδραματίσει καθοριστικό ρόλο στην διαμόρφωση του. Επίσης, προξενεί εντύπωση το γεγονός ότι χρειάστηκε να περάσουν δεκαετίες και πιο συγκεκριμένα από τα μέσα του 19ου μέχρι το 1913 ώστε να δημιουργηθεί το Υπουργείο Εργασίας-Department of Labour, το οποίο αποτελεί μία οργάνωση με επιρροή και επιθυμεί να επηρεάσει τις αποφάσεις από επιχειρηματικά συμφέροντα μέχρι την ένωση εκπαιδευτικών (Λάβδας, 2004).
Η θεσμική αναγνώριση πραγματοποιείται το 1946 όταν κωδικοποιείται η νομοθεσία για το Lobbying με τον Ομοσπονδιακό Νόμο Ρύθμισης και Άσκησης Παρασκηνιακής Πίεσης, στον οποίο καθορίζονται οι διαδικασίες για την λειτουργία του lobbying και συγκεκριμένα στο εδάφιο 307 δίνεται και ο ορισμός του τι είναι λομπίστας (United States General Accounting Office, 1946). Συγκεκριμένα, αφορά οποιοδήποτε άτομο το οποίο είτε το ίδιο είτε μέσω ενός άλλου δρώντα έμμεσα ή άμεσα, λαμβάνει αμοιβή ή άλλα αντικείμενα αξίας με σκοπό να επιτελέσει την αποδοχή ή απόρριψη νομοθεσίας στο Κογκρέσο των ΗΠΑ και δεύτερον την επιρροή άμεσα ή έμμεσα ενσωμάτωσης ή απόρριψης νομοθεσίας (Wright et al., 2002). Επίσης, στο ίδιο εδάφιο περιγράφονται με λεπτομερή τρόπο οι υποχρεώσεις αναφορικά με την εγγραφή των ατόμων αυτών στο αντίστοιχο μητρώο, καθώς και την υποχρέωση να δηλώσουν τα προσωπικά τους στοιχεία αλλά και του εργοδότη τους, την διάρκεια της εργασίας τους και την αμοιβή την οποία θα λαμβάνουν. Στην πορεία και δη το 1995, η νομοθεσία εξελίχθηκε με το Lobbying Disclosure Act, νομοθετική πράξη η οποία αποτέλεσε «καταλύτη» αναφορικά με την λογοδοσία των lobbies και κάλυψε αρκετά κενά από την προηγούμενη νομοθεσία καθώς, ενισχύεται η λογοδοσία και η διαφάνεια και συνέβαλε στην πιο αυστηρή ρύθμιση της πρακτικής του lobbying (Λάβδας, 2004).
Επί της ουσίας, οι εταιρείες lobbying αποτελούν νομικά πρόσωπα τα οποία προσφέρουν τις υπηρεσίες τους σε οργανωμένα συμφέροντα τα οποία επιθυμούν να έρθουν σε επικοινωνία με κάποιο κρατικό παράγοντα με δύο στόχους, αφενός να παρουσιάσουν τις θέσεις τους και αφετέρου να επηρεάσουν την δημόσια πολιτική (Λάβδας, 2004). Επιπροσθέτως, αυτό το φαινόμενο δεν συναντάται μόνο στο ομοσπονδιακό επίπεδο αλλά σε όλα τα επίπεδα διακυβέρνησης όπως τις πολιτείες, τις περιφέρειες ή τους δήμους. Συγκεκριμένα, υπολογίζεται ότι στις Ηνωμένες Πολιτείες το 2023 δαπανήθηκαν περισσότερα από τέσσερα δισεκατομμύρια δολάρια σε δραστηριότητες άσκησης επιρροής (Massoglia et al., 2024). Στο σημείο αυτό, πρέπει να αναφερθεί και ο θεσμός των Political Action Committees ( PAC ) ο οποίος στις Ηνωμένες Πολιτείες έχει ιδιαίτερη σημασία. Αυτό επειδή, τα PAC αποτελούν οντότητες οι οποίες αντλούν συνεισφορές από τα μέλη τους και ύστερα διοχετεύουν αυτούς τους πόρους υπέρ ή κατά υποψήφιων, προεκλογικών εκστρατειών και νομοθεσίας καθώς τα έξοδα διεξαγωγής μιας εκστρατείας κυμαίνονται σε αστρονομικά επίπεδα (Λάβδας 2004, σελ. 231).
Στην άλλη μεριά του ατλαντικού, η Ευρωπαϊκή Ένωση αποδίδει ιδιαίτερη σημασία στην λειτουργία των εταιρειών lobbying και τονίζει συνεχώς την ανάγκη για διαφάνεια και λογοδοσία καθώς και διάλογο με αντιπροσωπευτικές οργανώσεις και την κοινωνία των πολιτών όπως αναφέρεται στο άρθρο 11 της Συνθήκης Ευρωπαϊκής Ένωσης (Transparency International, 2024). Επιπλέον, το Ευρωπαϊκό Κοινοβούλιο, η Ευρωπαϊκή Επιτροπή και το Συμβούλιο της Ευρωπαϊκής Ένωσης διαθέτουν Μητρώο Διαφάνειας το οποίο είναι προσβάσιμο σε όλους και σε αντίθεση με τις ΗΠΑ απουσιάζει ο θεσμός των PAC και δίνεται σημαντική έμφαση στη διαφάνεια και τη λογοδοσία καθώς και την πρόσβαση από τους πολίτες σε αυτά τα δεδομένα. Η εγγραφή στο Μητρώο Διαφάνειας είναι απαραίτητη για όσους σκοπεύουν να επηρεάσουν την δημιουργία και εφαρμογή της δημόσιας πολιτικής στους θεσμούς της Ευρωπαϊκής Ένωσης.
Παρά τα θετικά στοιχεία που μπορεί να προσφέρει, η πρακτική του lobbying ενέχει σημαντικούς κινδύνους και ιδιαίτερα όταν λειτουργεί σε συνθήκες θεσμικής ασάφειας ή ανεπαρκούς ρύθμισης. Σε περιπτώσεις στις οποίες δεν υπάρχει σαφές νομικό και θεσμικό πλαίσιο, είναι δύσκολο να διακρίνει κανείς αν ενέργειες όπως η παροχή δώρων, γευμάτων ή ταξιδιών αποτελούν μορφές νόμιμης επιρροής ή συγκαλυμμένης δωροδοκία και κινούνται εντός ενός νομικά ασαφούς πλαισίου. Σημαντικό ρόλο στην απώλεια εμπιστοσύνης από την κοινωνία των πολιτών προς το πολιτικό σύστημα στις ΗΠΑ έχει προκύψει εξαιτίας του φαινομένου της περιστρεφόμενης πόρτας (revolving door). Συγκεκριμένα, η κινητικότητα κυβερνητικών αξιωματούχων σε υψηλές θέσεις στον ιδιωτικό τομέα ως λομπίστες αλλά και το αντίστροφο ,δηλαδή από στελέχη εταιριών σε κυβερνητικές θέσεις, καθιστά δυσδιάκριτα το όρια μεταξύ ιδιωτικού και δημόσιου τομέα και αυτή η εναλλαγή ρόλων δημιουργεί ένα δίκτυο αμοιβαίων εξαρτήσεων εντείνοντας με αυτό τον τρόπο την ανησυχία των πολιτών. (Drutman, 2015). Επιπροσθέτως, η πρότερη υπηρεσία αυτών των ατόμων στην δημόσια διοίκηση έχει ως αποτέλεσμα να έχουν δυνάλογη επιρροή στις διαδικασίες λήψης αποφάσεων εξαιτίας της δικτύωσης τους σε υψηλά ιστάμενους κύκλους (Vidal J. et al. 2012) .
Στη συνέχεια, το lobbying έχει την δυνατότητα να προσφέρει πολύτιμες γνώσεις σε κυβερνητικό επίπεδο, καθώς οι εταιρείες lobbying στελεχώνονται κυρίως από τεχνοκράτες, δικηγόρους και οικονομολόγους. Παρά ταύτα, το lobbying μπορεί να λειτουργήσει θετικά εφόσον ασκείται σε συνθήκες διαφάνειας και λογοδοσίας, ιδιαίτερα όταν εκπροσωπούνται οργανώσεις της κοινωνίας των πολιτών ή ευάλωτες ομάδες, μπορεί να οδηγήσει σε μεταρρυθμίσεις οι οποίες ωφελούν το κοινωνικό σύνολο. Ενδεικτικά, στις Ηνωμένες Πολιτείες, η οργάνωση Mothers Against Drunk Driving (MADD) συνέβαλε καθοριστικά στην αύξηση του νόμιμου ορίου ηλικίας για την κατανάλωση αλκοόλ στα 21 έτη (Yu et al, 2018). Αντίστοιχα, η δράση του ελληνικού lobby στις ΗΠΑ έχει συνεισφέρει στη διατήρηση των στρατηγικών σχέσεων μεταξύ Ηνωμένων Πολιτειών και Ελλάδας, θέτοντας τακτικά στο επίκεντρο θέματα εθνικού ενδιαφέροντος.
Σε καμία περίπτωση, αυτό το πολυσχιδές φαινόμενο δεν αποτελεί πανάκεια και για αυτό τον λόγο μία πολιτεία οφείλει να φροντίσει για αυξημένη λογοδοσία η οποία θα περιορίσει την διαφθορά και θα αποκτήσει την εμπιστοσύνη της κοινωνίας των πολιτών. Πολλές φορές αποφάσεις που είναι αποτελέσματα lobbying όπως, για παράδειγμα οι νόμοι σχετικά με τις αμβλώσεις ή αναφορικά με την χρήση και κατοχή συγκεκριμένων ειδών πυροβόλων τυφεκίων έχουν οδηγήσει σε πόλωση και έντονη συζήτηση στη δημόσια σφαίρα. Από τα παραπάνω, προκύπτει ότι σε κάθε περίπτωση το lobbying αποτελεί μία ευκαιρία για προώθηση ουσιαστικών ζητημάτων στα υψηλότερα κυβερνητικά επίπεδα, όμως η απουσία ρυθμιστικού περιεχομένου θα προκαλέσει φαινόμενα διαπλοκής τα οποία με τη σειρά τους θα θέσουν σε αποξένωση την κοινωνία των πολιτών και θα προκαλέσουν ή θα εντείνουν την ήδη υπάρχουσα δυσπιστία απέναντι στο πολιτικό σύστημα και τους θεσμούς.
